New York Five Hour Course, LLC
By accessing and using the New York Five Hour Course website and services ("Service"), you accept and agree to be bound by the terms and provision of this agreement. These Terms of Use constitute a legally binding agreement between you and New York Five Hour Course, LLC.
If you do not agree to abide by these Terms of Use, please do not use this Service.
New York Five Hour Course provides an online pre-licensing course as part of the NYS DMV's Online Pre-Licensing Pilot Program. This service is designed for individuals who hold a valid New York State learner's permit and are required to complete a 5-hour pre-licensing course before taking their road test.
The Service includes course materials, interactive content, progress tracking, and automatic reporting of course completion to the New York State Department of Motor Vehicles (NYS DMV).

As required by NYS DMV regulations, you must complete identity verification processes. You understand that course completion will only be reported to the NYS DMV upon successful verification of your identity.
To enroll in the course, you must hold a valid New York State learner's permit. Course completion certificates are only valid for individuals who meet NYS DMV requirements.
You have 30 days from enrollment to complete the 5-hour course. The course must be completed in its entirety to receive credit. Extensions may be granted at our sole discretion.
Upon successful course completion, your completion status will be automatically reported to the NYS DMV. This process typically takes 24-48 hours. We are not responsible for delays in DMV processing.
The course fee is $44.95 and must be paid in full before course access is granted. All fees are non-refundable except as described below.
Refunds may be provided within 7 days of enrollment if you have not completed more than 25% of the course content. Technical issues that prevent course completion may be eligible for refunds at our discretion.
All content, materials, and intellectual property on this Service are owned by New York Five Hour Course, LLC or its licensors. This includes but is not limited to:

To the fullest extent permitted by applicable law, New York Five Hour Course, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.
Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid for the course.
We reserve the right to modify, suspend, or discontinue the Service at any time without notice. We do not guarantee that the Service will be available at all times or free from interruptions.
We may also modify these Terms at any time. Continued use of the Service after modifications constitutes acceptance of the modified Terms.
These Terms shall be governed by and construed in accordance with the laws of New York State, without regard to its conflict of law provisions. Any legal action or proceeding shall be brought exclusively in the courts of New York State.

When you enroll in our course, you must opt-in to receive SMS text messages containing one-time PIN (OTP) codes to validate your identity throughout the course. These verification codes are required by NYS DMV regulations to ensure that you are the person completing the course material. You will receive these OTP codes at various checkpoints during your course progress.
You can cancel the SMS service at any time. Just text "STOP" to the short code. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, sign up as you did the first time and we will start sending SMS messages to you again.

Carriers are not liable for delayed or undelivered messages.
As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive OTP verification codes at various checkpoints throughout your course (typically 7-10 messages during the entire 5-hour course).
